Throughout the site, the terms “we”, “us” and “our” refer to Quintet Cellars. Quintet Cellars offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Online Store Terms

Any wine sold by Quintet Cellars is sold in Oregon and title passes to you, the buyer, in Oregon. By using this site and agreeing to these terms and conditions, you swear and avow that you are 21 years of age or older. Without exception, every person using the Quintet Cellars website or receiving a shipment of our wine must be 21 years of age or older. In every case Quintet Cellars will cooperate with authorities in prosecuting you for any violation of your state’s drinking age.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

State Restrictions & Limits

Many states restrict the amount of wine a consumer can have shipped from a winery or all wineries in aggregate. By placing an order on Quintet Cellars’ website you formally represent that you have not exceeded any of your state’s limits on aggregate purchases and/or shipments.

Sales Tax

Quintet makes every effort to charge correct sales tax for your location as supplied by Taxjar, our sales tax software provider. We are consistently receiving updates to our software but we make no warranty that sales tax is correct for your location or updated at the time of your purchase. We make no sales refunds should there be a tax charge error but we would welcome an email if you suspect the sales tax you have been charged is incorrect for your location so that we may investigate and adjust if necessary. Sales Tax is calculated by zip code by our sales tax software provider.

Shipping and Returns

Shipments require the signature of an adult 21 years of age or older in order for delivery to occur and proof of age must be given. Shipments cannot be left at your door and for this reason we advise you to give Quintet Cellars a daytime delivery address. Deliveries can only be made to physical addresses. We cannot ship to post office boxes or APO/FPO addresses. Additional shipping charges incurred due to a wrong address, and shipments returned to the winery due to inability to deliver, will be charged to your account.

Wine is perishable and can be damaged by heat or cold in transit. Quintet works hard to make sure shipments arrive in good condition. Should weather appear unfavorable for shipping; at our discretion we may delay shipment until conditions are more favorable. We will advise you via email should it become necessary to delay shipment. Your order is shipped from Oregon wine country, we encourage our customers to choose premium carrier service in order to ensure rapid delivery when shipping coast to coast or to the Midwest, the less time on the truck the better for your wine. When your wine is shipped, you will receive a tracking number via email.

All wines are sold in Oregon and title passes to the buyer in Oregon. All sales of wine are final. Your orders are fulfilled and shipped by Oregon Wine Services (OWS) who act as packager and shipper of your wine once purchase is made. If bottles should be damaged in shipment you should contact Katie Terry at OWS in order to file a claim. OWS insures your orders and engages UPS or FedEx depending on how you select to deliver your order. For any shipping problems please email [email protected] with a copy to [email protected] in order for OWS to file a claim on your behalf with the UPS or FedEX.

Quintet Cellars links our customer to websites operated by third parties such as, but not limited to, restaurants, wine bottle shops, and articles on wine or the wine industry. Quintet Cellars has no control over these third-party sites as they all have their own terms and conditions and data collection practices. These third-party sites are for your convenience: you access third-party sites at your own risk. Even so, Quintet Cellars seeks to protect the reliability of our website and requests that you contact us with any criticism of our website or any third-party sites that are accessed through Quintet’s website.

General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

Modifications to the Service and Prices

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Products or Services

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Oregon.
